Class Action Lawsuit Against Volkswagen

A proposed class action lawsuit has been commenced in the Federal Court of Canada against Volkswagen alleging breach of certain provisions of the Competition Act and of the Canadian Environmental Protection Act as a result of certain diesel engine vehicles that were equipped with a defeat device.

The claim alleges that those vehicles do not comply with Canadian emission standards, and as such cannot live up to the representations that they had a cleaner burning engine while being more powerful and better performing than their gasoline counterparts.

Mussio Goodman and Branch MacMaster LLP are counsel for the plaintiff and for the proposed class.

It is estimated that there are in excess of 100,000 affected in Canada. Our current understanding is that the affected vehicles include the following models:

  • 2009-2015 VW Jettas
  • 2009-2015 VW Beetles
  • 2009-2015 VW Golfs
  • 2014-2015 VW Passats
  • 2009-2015 Audi A3s  

If you purchased or leased one of the affected vehicles, you may be part of the class if the action is certified as a class action.
